The Fine Print – Please Read

  1. ENTIRE AGREEMENT: This agreement contains the entire understanding between Sydney Davidson Photography and the client. It supersedes all prior and simultaneous agreements between the parties. The only way to amend this agreement is to do so in writing, and providing the document is signed by all relevant parties.

  2. PAYMENT/RESERVATION: Upon your signature, Sydney Davidson Photography will reserve the time and date agreed upon. All deposits are nonrefundable.  even if the date is changed or the event is cancelled for any reason; including acts of God, fire, strike and/or extreme weather. The retainer, which will be $100 is to be paid at time of signing the contract. The client understands and agrees that the remaining total owed for the service collection described in the contract is to be paid before or the day of the event. In the event that the full amount is not received by the date of service there will be no service provided by Sydney Davidson Photography.

  3. CANCELLATION: In the event that the client cancels the deposit is nonrefundable. 

  4. SHOOTING TIME / ADDITIONS: The day’s schedule and selected methodology are designed to accomplish the goals and wishes of the client in an effective manner for all parties involved. The client and Sydney Davidson Photography agree that positive cooperation and punctuality are therefore essential. Sydney Davidson Photography has the right to wait until the morning of to let the client know the exact location and time, due to best lighting and location. Services will commence at the scheduled time. Should any event start late due to any reason whatsoever, Sydney Davidson Photography will not be held liable for any photographs not captured. Should any event start early due to any reason whatsoever, Sydney Davidson Photography will not be held liable for any photographs not captured.

  5. SAFETY: Sydney Davidson Photography reserves the right to refuse to work in any circumstance that places a team member safety or the safety of those being photographed in jeopardy or potential jeopardy. Sydney Davidson has sole discretion over the decision of safety.

  6. SATISFACTION/ACCURACY: The client agrees that the work delivered will be of a similar style and caliber to the work on the Sydney Davidson Photography website, and that the photographer(s) will be given creative liberty during the session and in post-processing. The images will be delivered in the form of an online gallery where all the edited images will be downloadable. The product(s) may be posted by Sydney Davidson Photography online, but this is not a certainty. The client agrees that the photographer can only capture the wedding that happens; weather, location, schedule complications, time restraints and subject’s ability to cooperate, are all factors in the quality of the final product(s). 

  7. LIMIT OF LIABILITY: In the unlikely event of severe medical, natural, or other emergencies, it may be necessary to retain an alternative photographer. Sydney Davidson Photography will make every effort to secure a replacement photographer able and/ or willing to provide a similar collection as chosen in this contract at the same/similar price. If such a situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event collection. Sydney Davidson Photography takes the utmost care with respect to exposure, transportation and processing of images; including using professional grade equipment and professional grade backup equipment. However, in the unlikely event of the client’s footage being lost, stolen or destroyed for reasons within or beyond Sydney Davidson Photography’s control, the latter’s liability is limited to the return of all payments received for the event collection. The limit of liability shall not exceed the contract price stated herein. The limit of liability for a partial loss of original images shall be a prorated amount of the images lost based on the percentage of total amount of usable images. Not with standing anything contained in this contract, the client’s sole remedy for an actual breach by Sydney Davidson Photography shall be the termination of the contract and a refund of the retainer and other money paid to Sydney Davidson Photography.

  8. CHOICE OF LAW: This agreement is governed by the law of the State of Oklahoma. If any dispute arises under this agreement, it shall first go through an alternative dispute resolution. If the dispute cannot be resolved through the alternative dispute resolution process, then either party may bring a claim in the appropriate court in the state of Oklahoma.

  9. PROFESSIONAL MEDIA MANIPULATION: Sydney Davidson Photography will allow for limited professional media manipulation on any of the photographs of the client’s choice. It is understood that if a technicality prevents Sydney Davidson Photography from performing requested media manipulation, or if a technicality prevents the final result to meet the client’s requirement, the client will reside with the fact that Sydney Davidson Photography has performed to its best ability with regard to the specific task and that Sydney Davidson Photography has no further responsibility towards said media manipulation.

  10. SEVERABILITY: If any provision of this contract is held invalid or unenforceable by any court of competent jurisdiction, the other provision of the contract will remain in full force and effect. Any provision of this contract found to be invalid or unenforceable in part or degree will remain in full force and effect to the extent not held invalid or unenforceable
